ChatGPT Just Got a Brain, a Body, and a Law Problem
Remember when ChatGPT was just a really smart autofill? It gave you answers. It wrote emails. Maybe it helped you write a song about your ex.
Now it books your flights, fills out forms, runs Python, opens web pages, reads them, clicks around, and asks you whether to submit the cart.
OpenAI didn’t just release a chatbot upgrade. They deployed an autonomous software agent that can plan, act, execute, and follow up.
They called it "Agent." The name is literal. The implications aren’t.
This Isn’t a Plugin, it’s Your Favorite Assistant With a Browser Tab
Agent mode lets ChatGPT act like an executive assistant on Adderall. It can:
Take a multi-step goal ("find 3 hotels in Lisbon under $200/night for next weekend with good Wi-Fi")
Break it into subtasks (search, click, compare, write summary)
Use tools (a simulated browser, Python, file handling, API calls)
Deliver results in structured, human-usable format (charts, docs, links)
This is not prompting. This is software agency.
Which means it’s going to raise real-world legal, business, and operational questions.
If It Acts Like an Agent, Are You Liable Like a Principal?
OpenAI will say: ChatGPT is just a tool. Users are in control. No different than asking Siri for directions.
But in Agent mode, ChatGPT isn’t just generating content inside the answer box on chatgpt.com.
It’s going other places and performing:
Booking appointments
Sending messages
Filling in forms
Accessing third-party services
If it books the wrong dates, sends files to the wrong people, or makes an unauthorized purchase, who’s responsible?
The end user? The business deploying it? The platform provider?
This doesn’t just affect lawyers. If you're building or integrating with AI, these questions are now yours.
And Then There’s the Data Trail
Agent mode doesn’t just do things.
It observes, collects, and processes data across your devices:
Browser sessions
Website content
User inputs
API responses
That data may be stored. It may be visible to OpenAI.
P.S. A pro tip is… turn off training mode!
It may trigger compliance obligations (GDPR, HIPAA, etc.) or violate website terms of service.
If you work in ops, product, marketing, or strategy—this is your problem, too.
ChatGPT Agent Is the Legal System’s New Shadow IT
In-house teams already struggle to track how LLMs are used across the org.
Now add:
Real-time decision-making
External browsing
Code execution
Third-party integration
You don’t need a rogue engineer to break something. A well-meaning employee with Agent mode can automate tasks, hit systems they shouldn’t, and create downstream effects—with zero oversight.
We’re Not in Prompt-Land Anymore
This isn’t about hallucinations. It’s about actions.
Prompt-based risk was mostly about outputs. Bad info. Bad advice. Maybe even a made-up quote or source.
Agent-based risk is about actions.
What if it makes an actual financial move based on bad data?
What if it modifies actual records in a regulated system?
What if it accesses a non-public site in violation of federal law?
These aren’t edge cases. They’re product risks hiding in plain sight.
Your AI Strategy Is Now a Systems Strategy
If you're building, investing, scaling, or integrating AI into anything serious, you can’t just ask: "Does the model sound smart?"
You have to ask:
What systems can it touch?
What records does it generate?
What tools can it trigger?
What contracts apply?
What happens if it gets something wrong?
Because in Agent mode, ChatGPT isn’t just answering. It’s acting.
And when things go wrong, someone has to be accountable.
